Importing and Distributing Medicines in Ethiopia: Licensing and the Local Agent
Ethiopia's pharmaceutical market is one of the largest in East Africa — and one of the most import-dependent. The great majority of medicines consumed in the country are manufactured abroad, which means that for foreign pharmaceutical companies the commercial question is rarely whether to supply Ethiopia but how: through whom, under what licences, and with what ongoing obligations. The regulatory answer runs through a single authority — the Ethiopian Food and Drug Authority (EFDA) — and a framework that many foreign manufacturers underestimate, because it regulates not just the product but the chain: the manufacturer, the local agent, the importer, the warehouse, and the wholesaler each need their own authorization, and a gap anywhere in that chain stops the medicine at the port.

The framework, in brief
Medicines regulation in Ethiopia is governed by the Food and Medicine Administration Proclamation No. 1112/2019, with the EFDA operating under its organizational mandate (Council of Ministers Regulation No. 531/2023) and a body of EFDA directives and guidelines that carry the operational detail. The most significant recent development is the Inspection Manual for Good Storage, Distribution, and Dispensing Practices, issued by the EFDA in 2025, which sets the current standards inspectors apply to importers, warehouses, and wholesalers. Two authorizations sit at the heart of the system, and they are frequently confused:
The product must be registered. No medicine may be imported or sold without a valid marketing authorization issued by the EFDA for that specific product. Registration is the manufacturer-side approval: dossier review, quality assessment, and — for foreign production sites — GMP evaluation. The importer must be licensed. Separately, the Ethiopian entity bringing the product in must hold its own EFDA authorization — a Certificate of Competence for pharmaceutical importation. In practice this requires dedicated, compliant storage premises with controlled temperature and humidity (and logged monitoring), and the full-time employment of a qualified, licensed pharmacist as technical manager.
A registered product with an unlicensed importer cannot enter; a licensed importer cannot bring in an unregistered product. Both tracks must be in place, and they should be planned together from the outset.
The local agent: the pivot of the system
Foreign pharmaceutical manufacturers cannot simply sell into Ethiopia at a distance. The system is built around a local agent — a licensed Ethiopian pharmaceutical importer, formally appointed by the foreign manufacturer under a written agency agreement signed by both parties and submitted to the EFDA — to represent the manufacturer before the regulator and in the market. The appointed agent is, in practice, the entity authorized to handle the product's registration.
The agent's role is substantive, not ceremonial. It typically holds or coordinates the product registrations, handles import permits and port clearance, manages pharmacovigilance reporting, and carries local regulatory responsibility for the products it represents. Two features make the agency relationship the single most consequential commercial decision a foreign manufacturer makes in Ethiopia — and one of the most common sources of dispute:
First, product registrations are tied to the manufacturer (the marketing-authorization holder), but the local agent is the operational gatekeeper. If the relationship ends, changing the local agent is not automatic — it requires a formal variation application to the EFDA, and until that is processed and approved, imports can be blocked. Second, the agreement itself governs everything the regulator does not: exclusivity, territory, the allocation of regulatory responsibilities, liability, and — critically — the mechanics and cooperation required to transfer registrations and effect the variation if the parties separate. Import permits: per consignment, at the port
Beyond product registration and importer licensing, each shipment requires its own pre-import permit issued by the EFDA in advance. The permit ties a specific consignment to a registered product and a licensed importer; supporting documentation typically includes the proforma invoice, purchase order, and the valid marketing authorization. At designated ports of entry, EFDA inspectors verify the shipment, assess storage and transport conditions, and may pull risk-based samples for laboratory testing before customs release. The practical consequences: import planning has to build in permit lead time; documentation must match the registration exactly (labeling, pack size, manufacturing site); and discrepancies between the shipment and the registered particulars are a leading cause of consignments held at port.
Distribution: wholesale licensing and storage standards
Once inside the country, medicines move through a licensed chain. Wholesale distribution requires EFDA authorization, with premises, personnel, and storage meeting good storage and distribution practice standards under the 2025 Inspection Manual — including continuous temperature monitoring, sanitation controls, and cold-chain requirements (specialized cold rooms, continuous monitoring, and backup power) for temperature-sensitive products such as vaccines and biologicals.
For products destined for the public health system, the dominant channel is the Ethiopian Pharmaceutical Supply Services (EPSS) — the centralized public supply agency under the Ministry of Health, which aggregates national demand, procures through competitive tender, and distributes through its regional network. Supplying the public sector through EPSS is a distinct commercial route, with its own procurement rules, separate from the private wholesale market.
After market entry: the obligations continue
Import and distribution authorizations are not one-time events. Marketing authorizations follow a renewal cycle (commonly five years); variations to the product — site changes, labeling, formulation, and indeed changes of local agent — must be approved through the EFDA's variation workflow before they take effect; and the manufacturer and agent carry pharmacovigilance obligations, including adverse-drug-reaction reporting to the national system. When a recall is required, the importer must act promptly on EFDA notification, through the licensed chain. A foreign manufacturer's Ethiopian compliance is only as good as its agent's systems — one more reason the agency agreement, and the agent's actual capacity, deserve scrutiny before signature.
Where shipments and market entry most often fail
The recurring problems we see are rarely exotic. They are: an agency agreement that does not address registration control and the variation process on termination; import documentation that does not match the registered particulars; storage or cold-chain gaps discovered at inspection; permit timelines not built into supply planning; and manufacturers assuming that product registration alone confers the right to import. Each is avoidable with structure set up correctly at the start.
What manufacturers and importers should do
1. Plan both tracks together. Product registration and importer licensing run in parallel; sequencing them badly costs months of market time.
2. Treat the agency agreement as the key legal asset it is. Registration control, the termination and variation mechanics, and liability should be negotiated before the relationship begins — not litigated after it sours.
3. Build permit and clearance timelines into the supply chain. Per-consignment permits and port verification are part of the delivery schedule, not an afterthought.
4. Audit the chain's compliance capacity. The agent's and distributor's premises, personnel, and pharmacovigilance systems carry your product's compliance — verify them.
